Topmonhit Story '08 Holiday Special: Season Stalkings is the 2008 Topmonhit Story Christmas special. It involves an insane toad believing that Santa Claus is stalking him (due to him supposedly always watching you), and therefore he sues him.

Story
Part 1
In an empty room save for a toad with rainbow spots and a radio, a toad was listening to said radio, which was playing Santa Claus is Coming to Town. Immeidately the toad jumped up and began to sing instead Santa Claus is Stalking You Down. Once that was over, it cut to Top's House, where there was a peaceful snow out. Top was excited about it almost being Holiday, and Topper was flipping through television channels when he went past "to be suing Santa". Oshy told him to go back, and they watched as News Guy and Toadette reported on a toad claiming that Santa Claus was stalking him, and was sueing Santa over these charges.
Toadette said they had gotten an interview with the toad, who yelled that Santa was stalking him. Toadette asked why he thinks this, and he said that Santa is constantly watching everyone, stalking them for his own evil purposes. When asked about the people who think he's crazy, the toad answered that they had all bought into the Christmas business and that Santa was truly evil. News Guy reported that an angry mob had just formed outside the studio. When News Guy, Toadette and the crazy toad came out, the mob threw candy canes at the toad.
Just then everyone heard sleigh bells in the sky, and saw as a sleigh pulled by winged white Yoshis flew overheard. News Guy spoke of it as amazing, but the crazy toad yelled that Santa was also mean to yoshis (which resulted in another candy cane hitting him). The sleigh landed, and out came Santa. The crazy toad tried to attack him, but some security guards held him back. Santa asked what all the business about being him being sued was, and the News Guy explained. Santa thought the notion was silly, but the crazy toad yelled that he was planning to turn everyone into mindless elves or something. News Guy reported that they would have coverage of the proceeding trial.
Meanwhile, at the Warioware Office Building, Wario and Waluigi were watching this news. Wario was surprised to see Santa actually existed, mostly because he never got anything from him. Waluigi was sarcastic, but Wario figured if Santa thought he was good enough to skip Wario, he had another thing coming, and they went to get the Warioware Jet... except there wasn't one. At Top's House, Oshy said this was nearly as bad as a crazy turtle trying to steal Christmas. Topper suggested to Top that he should make a call, and though Top was confused at first, Topper said Santa would need a lawyer. Meanwhile, at Not There, someone recieved a call from Top about the situation. Deciding to help, Top's Lawyer hung up and prepared to get his lawyer face on.
Part 2
At the courthouse, Santa was feeding some of his winged yoshis some berries when Top ran up, asking for Rareware for Holiday. Oshy and Topper came up, and Oshy asked Santa if he remembered them from a couple years ago (with Topper complaining that he thought they were done with YB things that he wasn't around for). They asked Santa if he had a lawyer, and when he said he didn't, Top said he had hired one for him. Just then Top's Lawyer showed up behind them, having gotten there via magic teleportin station, but the crazy toad laughed at the pumpkin lawyer, saying The Great Bagel could beat him up.
Topper said he had no clue why they even needed a lawyer, but Top's Lawyer suspected the crazy toad had one himself. At the North Pole, Wario and Waluigi finally landed in their hot air balloon. They got out, and Wario told Waluigi to help him set up the camera equipment. After they did and Wario was dressed as Santa, he told Waluigi to go jam their satellite communications. Waluigi put on a camoflouge outfit similar to Solid Snake's and began to sneak into the workshop, singing "wa" with the song Theme of Tara.
When he was nearly found he hid inside a box wrapped like a present, and was brought inside by the elves. He eventually made it into the sattelite signal devices room and disabled it, after which he sent the signal to Wario's camera. When the camera turned on, the elves saw Wario picking his nose. When he realized the camera was on, Wario tried to act like Santa and told the elves he had won the trial, and when he came back he was going to make some changes.
Part 3
As the trial began, they learned the crazy Toad had no lawyer. Top's Lawyer came up and began, stating that the term "stalking" meant "following or harassing another person, causing them to fear death or injury". Top's Lawyer said Santa was not following or harassing anyone, simply watching if they were naughty or nice. He said they all knew the story of Santa, and shouldn't have to tell them. When the crazy Toad came up, he yelled that he was fearing injury because Santa breaks into houses.
At the North Pole, the elves were shocked at Wario's new rule: To stop delivering toys and presents, and instead deliver his underwear and keep all the "loot" for him. Waluigi agreed, but then quickly went back to saying "yoshi" as he was disguised as one of the flying yoshi. Wario began to sing Wario Claus, in which Waluigi tried to sing too but Wario told him to pipe down (as he was still disguised as a yoshi).
Back at the trial, two and a half hours had gone by; it would have ended sooner, but the crazy Toad kept bringing up "evidence" including "a holiday ham, a stocking, an ornament, and pie". He also had a bunch of witnesses, including "Pryo, Sails the blue fox, every single entry in the YBpedia that was never used for anything, SGMta, SZMta, SPMta, SPMta-da, a patridge in a pear tree, and Homestar Runner", the last of which said he knew "Dw. Chwistmas" was up to "some good".
In the end, the jury took five seconds to come to a decision, which was "not guilty" and that the toad was crazy. The crazy toad was exhasperated at this, while everyone else was joyous. Santa didn't have time to celebrate, though, as he had to get back to the North Pole, but as he tried to contact the elves, he found he couldn't get a signal. Top suggested something was wrong (which was just a ploy so he could go to the North Pole), and so Team TOT and Top's Lawyer headed to the North Pole. Watching them with a menacing glare, however, was the crazy toad...
When they arrived at the North Pole, the shop was closed up. Topper knocked on the front door, and an elf said that nobody got in to see the Santa, but Santa said he was right there. The elves realized Wario was a fake, and they tried to make off before the elves got to them but were too late. Waluigi threw a bob-omb at the elves, but an elf hit it back with a tennis raquet and it hit them, knocking them out of the workshop (at which point Team TOT burst in). Top found it weird that they still had plenty of time to get ready, though.
Outside, Wario asked where the toad that was keeping Santa busy was, and Waluigi noticed he was right in front of them. Up ahead the crazy toad was riding a rocket towards them, planning on getting rid of him himself, and Wario yelled he wasn't Santa. The rocket hit them, and all three of them were sent blasting into the sky, and the story ended.

- This is the only Topmonhit Story Holiday Special of 2008.
- This is Top's Lawyer's first appearance in Topmonhit Story.
- Team TOT mention It's Freakin' a Freakin' YB Freakin' Holiday!, as they had first met Santa in that story.
- This is the first Holiday special Topmonhit was involved in where Kienstrom did not appear (save for a cameo that was made to make note that Kienstrom was not in the special).
- Topmonhit is incredibly confused, as the wiki would seem to have been made on January 10th, 2009, while the wiki is referenced in this story despite it being made December 2008. This may be referring to a thread that existed before the wiki was made.
